When asked about Smollett's status on the Fox drama - Smollett was removed from the final two episodes of Season 5 after he was charged with lying to police about his January 29 attack (the charges have since been dropped) - Henson said that "yes", Smollett will appear in Empire Season 6.

Among the risks for the city is that the civil litigation could end up costing far more in legal fees than it could ever hope to get from Smollett.

The city's law department also says in a statement Thursday that it would be drafting a lawsuit in response and would sue the "Empire" actor in Cook County Civil Court.

The City of Chicago says Jussie Smollett has refused to pay more than $130,000 USA to reimburse the costs of investigating what authorities say was a staged racist, anti-gay attack against him. "As part of this legal action, the Law Department will pursue the full measure of damages allowed", McCaffrey said in a statement.

Last Thursday, the mayor had the city's Law Department send Smollett a letter titled "Re: Repayment of Investigation Costs for False Police Report", requiring "immediate payment of the $130,106.15 expended on overtime hours in the investigation of this matter".

Chicago police have been unhappy with Cook County State's Attorney Kim Foxx following the dropped charges against Empire actor Jussie Smollett in March. On the same day, the Chicago Fraternal Order of Police along with dozens of suburban police chiefs called for the resignation of the prosecutor whose office stunningly dropped all 16 felony charges against Smollett without so much as an apology.

The prosecutor's office presented the case to a grand jury, which indicted Smollett on 16 charges of filing a false police report.

The city said more than a dozen detectives spent hundreds of hours investigating Smollett's claim that he was a victim of a racial and homophobic attack January 29 in Streeterville. "The Chicago Police Department conducted an extensive investigation into this report", the letter stated.

He claimed the attackers poured the bleach-like chemical on him and tied a rope noose around his neck, yelling racist and homophobic insults as well as "This is MAGA country".

Their disaffection began with lack of charges in attacks on police officers.

Jussie Smollett doesn't intend on paying back the Chicago Police after he orchestrated a hate crime against himself in an attempt to draw attention to his person and career.

The actor's criminal defense attorney, Mark Geragos, could not be reached for comment.
